Koyo is an AI interviewing product operated by Incanus Technologies Private Limited and its affiliates (“Newton School,” “Koyo,” “we,” “us,” or “our”). This Privacy Policy describes the personal data and/or personal information that we collect and process when you visit our website or use our AI-powered interview services and applications (collectively, the “Services”).

This Privacy Policy applies to our collection and use of your personal data or personal information (or equivalent terms). When we refer to your “data” or “information,” we mean personal data or personal information as defined under applicable law—information that identifies, relates to, describes, or could reasonably be linked to you as an identifiable individual.

1. Scope of This Privacy Policy

There are several ways to use our Services, and the data we collect depends on how you interact with Koyo.

You may use our Services as a:

  • Visitor to our website
  • Employer Representative using Koyo on behalf of an organization
  • User authorized by an employer to access Koyo
  • Candidate invited by an employer to participate in an AI-powered interview or assessment

When you use Koyo as a User or Candidate, the employer is the data controller, and Newton School (operating Koyo) is the data processor. When you interact with us directly as a Visitor or Employer Representative, Newton School acts as the data controller.

2. How We Collect Your Data

We collect and process your data in the following ways:

Automatically

We collect certain technical and usage data automatically when you access or use the Services, including information about your device, browser, IP address, usage activity, pages visited, and interactions with the Services.

Provided by You

We collect data you provide when you:

  • Create or access an account
  • Participate in an AI interview
  • Submit audio, video, or written responses
  • Communicate with us or request support

Provided by Employers

If you are a User or Candidate, the employer inviting or authorizing your access may provide us with personal data about you, such as identifying information and interview configuration details.

Received from Third Parties

We may receive information from third-party service providers that support hosting, analytics, security, identity verification, or platform functionality.

3. Data We Collect and Process

3.1 Data We Automatically Collect

  • IP address and approximate location
  • Browser, device, and operating system information
  • Usage logs, timestamps, and interaction data
  • Performance and diagnostic data

3.2 Data You Provide to Us

  • Identifiers: name, email address, phone number, username
  • Professional or Employment Information: role-related information, experience details (if provided)
  • Interview Interactions and Results: responses, transcripts, audio/video recordings, AI-generated summaries, scores, or structured insights (collectively, “Interview Results”)

3.3 Facial Image and Audio/Video Data (Candidates Only)

Certain interview features may require collection of audio, video, or facial images. These features are enabled at the employer’s discretion, and we shall provide you with sufficient notice and obtain consent before collecting such data.

3.4 Data Received from Third Parties

We may receive professional or identifying information from third-party providers assisting employers with candidate sourcing or platform integrations, where lawful.

4. How We Use Your Data

4.1 Purposes of Processing

We use your data to:

  • Provide, operate, maintain, and improve the Services
  • Conduct AI-powered interviews and generate Interview Results
  • Make Interview Results available to the relevant employer
  • Detect, prevent, and address security or fraud issues
  • Ensure compliance with applicable terms and laws
  • Communicate with you regarding service-related matters
  • Improve our Services using anonymized or aggregated data only
  • Comply with legal obligations

Koyo provides AI-generated insights to employers; all hiring and employment decisions are made solely by employers.

4.2 Processing Duration

  • Visitor and Employer Representative data is processed only as long as permitted by law or necessary for business purposes
  • User and Candidate data is processed only in accordance with the duration permitted in the employer’s agreement with Koyo or otherwise required by applicable law.
  • However, you may have a legal right to request that we delete or stop processing your data sooner. You may contact us at contact us details given at the end of the document. 

5. How We Disclose Your Data

We may disclose your data to:

  • Employers – Interview Results and related data
  • Service Providers – hosting, analytics, security, and support vendors
  • Affiliates – Newton School entities, where lawful
  • Integrations – third-party services enabled by employers
  • Legal Authorities – where required by law or to protect rights and safety
  • Business Transfers – in connection with mergers, acquisitions, or asset sales

We do not sell personal data.

6. Automated Processing and AI Features

6.1 AI Features

Koyo uses artificial intelligence and automated processing to analyze interview responses and generate structured insights.

  • Employers determine whether AI features are enabled
  • Results are provided to employers, who retain full discretion to make decisions on hiring
  • Koyo does not use AI features to make final or binding decisions

6.2 No Training on Personal Data

We do not train AI models on identifiable personal data. Any improvement uses anonymized, aggregated, or synthetic data only.

6.3 No Solely Automated Decisions

Koyo does not make decisions producing legal or similarly significant effects solely through automated processing.

6.4 Proctoring and Interview Integrity Features

Certain Koyo interview features may include proctoring or interview integrity measures enabled at the employer’s discretion. These measures are designed to help employers assess interview authenticity and fairness.

When enabled, proctoring features may involve:

  • Recording or monitoring audio and/or video during an interview
  • Capturing facial images or video frames at intervals
  • Monitoring interaction patterns, device signals, or behavioral indicators during the interview session
  • Analyzing such data using automated tools to identify potential irregularities

We provide notice to candidates when proctoring features are enabled and, where required by law, obtain consent before such data is collected or processed. If you do not consent to required proctoring features, you may not be able to participate in the interview and should contact the employer regarding alternative options.

Proctoring outputs are provided to the employer for review. Koyo does not make final determinations regarding interview outcomes, and all decisions remain solely with the employer.

7. Cookies and Similar Technologies

We use cookies and similar technologies to:

  • Operate and secure the Services
  • Analyze usage and performance
  • Improve functionality and user experience

You can manage cookie preferences through your browser settings. Disabling cookies may limit certain features.

8. Your Rights in Your Data

Depending on your jurisdiction, you may have rights to:

  • Access your personal data
  • Correct inaccurate data
  • Request deletion or restriction
  • Request data portability
  • Object to certain processing

If you are a User or Candidate, privacy requests should generally be directed to your employer. We will support employers in fulfilling such requests as required by law.

9. Children

We do not knowingly collect personal data from individuals under the age of 18. If we learn that we have collected personal information of a child under age 18, we will attempt to delete that personal data as soon as possible and take any other measures required under applicable law.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Changes are effective upon posting, and the “Last Updated” date reflects the most recent revision.

11. Grievance Redressal

In accordance with the Information Technology Act, 2000 and the rules made thereunder, including the Information Technology (Intermediary Guidelines) Rules, 2011, and the Digital Personal Data Protection Act, 2023, any grievances or concerns relating to the collection, use, storage, disclosure, or processing of personal data or information on the Platform may be addressed to the Grievance Officer.
